Access to and use of our Website is governed by all applicable laws and the present Terms & Conditions.
Please read all of these terms and conditions carefully before using our WebSite.
By using and browsing our WebSite, you signify your consent and agreement to all the present terms & conditions. If you do not agree to these terms, you are not permitted to continue using the Website.
All orders placed by private clients, natural persons, (hereinafter “Client”, “Clients” or “you /your”) with BA111OD, via the Website and relating to the products and the services provided by us are subject to the present Terms & Conditions.
Prior to your order, you declare to be of age or with the authorization of your legal representatives, and to have the full legal capacity, allowing you to commit yourself under these Terms & Conditions and your order towards BA111OD.
BA111OD reserves the right to modify at any time these Terms & Conditions.
General Sales Conditions
"All orders must be preceded by the Customer's validation of the present General Sales Conditions.
Terms & Conditions’s products are presented on a Product Sheet on which the Client has the opportunity, before finalizing his/her order, to verify the selling price, shipping costs based on the delivery address entered, as well as the description of the product.
To place an order, you must add the selected products to your shopping cart. The cart summarizes the products selected, as well as their prices.
You may at any time change or remove the products added in your cart before validating the order.
To place an order, you must follow the following steps:
1. Adding the product to the cart, a pop-up page opens, you must click on “Proceed to checkout” to access the next step;
2. Review order: you can view, check your cart, possibility to change the quantities or delete a product and indication of the total of the order, you must click on “process checkout” to access the next step;
3. Billing and delivery: You must complete the form to add your billing and shipping information and create an account. Verification of the information, possibility to add an invoicing address different from the delivery address.
4. Payment: you must choose the delivery and payment method. You must click on “Pay” to proceed with the payment.
5. Order Confirmation: Page confirming your order and payment.
All prices for products and services, applicable taxes and other charges are in Swiss Francs (CHF). We reserve the right to adjust prices as we may determine in our sole discretion, at any time and without notice.
All products offered for sale are subject to availability, and we reserve the right to impose quantity limits on any order, to reject all or part of an order, to discontinue offering certain products and to substitute products without prior notice.
Confirmation
Once the payment is made, the Client will receive an e-mail highlighting the essential information of the latter, mentioning the delivery information, as an indication. We recommend saving this e-mail since the order confirmation (receipt) also serves as guarantee of proof of the purchase.
If for any reason beyond its control, BA111OD cannot proceed with the delivery of the ordered product, it undertakes to send an informational e-mail to the Client to inform him/her of the follow-up and the processing of the order.
BA111OD retains ownership of the delivered products until full payment of the invoices and reserves the right to suspend delivery in the event of late payment and this until full settlement of the account.
BA111OD reserves the right to refuse any order for legitimate reasons, and in particular, without this list being exhaustive, in cases where the quantities ordered are abnormally high or unusual for a single Client, in case of fraud or attempted fraud and in case of payment incident.
Prices
The prices presented on the product page are in Swiss Francs (CHF), EUR or USD. The price you see on the product is the price including shipping & VAT (with the exception of the UK, the US and Canada).
Payment
We accept most major credit- and debit cards (e.g. Visa, MasterCard and American Express) and other local payment methods. If your payment is not confirmed, your order will not get processed.
Taxes
Please note that in specific cases (rare) you may be subject to import duties and taxes specific to your country, which would then be collected when the shipment reaches your delivery address. You will be responsible for payment of such special import duties and taxes. It should be noted that BA111OD has no control over these charges and, since these charges differ between countries, BA111OD cannot predict their amount. BA111OD advise you to contact your local customs office for further information.
Delivery
BA111OD ships in most countries. Deliveries are made with Fedex and their partners. Shipping costs are included for most countries without additional fee.
In cases the delivery is delayed in such a way you no longer wish to fulfill the purchase; it is your responsibility to cancel the order. In cases where the order has been dispatched, the Client is required to receive the order. Cancellation is not valid until the Client has confirmed with BA111OD by e-mail at service@ba111od.com.
If a product has been discontinued, BA111OD has the right to cancel the purchase and refund the paid amount to the Client. BA111OD will notify the Client if a replacement or equivalent product is available.
Returns & exchange
You have the right to return the product within 14 days from receiving the order free of charge.
The right applies only in the case that the product and its original packaging can be returned in the same condition as when received. Please contact service@ba111od.com to coordinate the return.
Please ensure that the product needs to be in its original shape when returning it. If the product has been used, BA111OD have the right to return the product to you.
All approved refunds will get processed within 14 days of arrival to our warehouse. Bear in mind that the bank transfer might take a couple of banking days to be visible in your account.
Please contact our Client Service if you have not received the refund within 20 days at service@ba111od.com.
Warranty
Your product come with a 2-year warranty under normal use, valid from the date of delivery. If you become aware of any defect in parts or craftsmanship during this time, BA111OD will, at its sole discretion, provide for repair or replacement of your product in accordance with the present Terms & Conditions. If your product's model or any parts original to your product's model is not available, a substitute of equivalent value will be provided for purposes of repair or replacement.
The warranty covers manufacturing defects on the product itself (movement, case, crystal). Other parts than mentioned above are not covered by this warranty. Damage of any kind if there is evidence that the damage was caused by an accident, improper use or mishandling of any part of the product, lack of care or improper maintenance, tampering or any factor other than a defect in the product's parts or craftsmanship, shall void this warranty.
To obtain repair or replacement of your product under this warranty, please contact the Client service department by using the email address service@ba111od.com. Please make sure to specify your serial number (chapter + model XXXX, see on the back case), your full name and a detailed description of the issue. If BA111OD cannot find any defects listed above, the product will be returned to the Client.
If you send your product for repair or replacement, you must ensure it is packaged carefully to avoid any damage during shipping. Damage resulting from repair, service, or alternation that is not handled through us directly is not covered under this warranty and shall void this warranty.
Afluendor Program
The Afluendor Program is open to any person more than 18 years old wishing to take part in it.
By acquiring a BA111OD product, you will receive rights of purchase to refer to your friends to acquire a BA111OD product. At no time the Afluendor can require a free watch from another chapter without the exceptional approval from BA111OD.
The Afluendor Program is open only within the limits of available stock. The available stock will be published in real time on the app.
This extra watch for free cannot be claimed as a financial compensation.
Should you fail to refer 4 or 6 of your friends before the end of the stock, you will lose any possibility to win an extra product.
The Client recognizes having no rights for claiming a compensation.
Gift vouchers
Gift vouchers are only valid for a limited time and the voucher must be used by the date shown on the voucher – check your voucher to find out how long it is valid.
BA111OD do not take any responsibility for stolen or deleted gift vouchers.
Additionally, BA111OD do not take responsibility for any gift vouchers that are lost or used by someone other than the recipient after delivery.
If a refund has been granted, this will be made in the same way as the original payment method.
Complaints terms
It is important that you as a Client carefully check your goods / products when you receive your shipment in order to verify that the product(s) is not damaged, and that the product(s) is correct. If your product is damaged during transport, whether the damage is visible or hidden, you must report this as soon as possible to the carrier. If you receive your item and see that it is damaged or does not match the one you ordered, you shall also contact BA111OD within 14 days from receiving the product.
Any complaints shall be sent to our client service at service@ba111od.com. Please include your order number and the reason for complaint and we will get back to you shortly. Same applies for returns. Defective products returned to BA111OD should be treated as if they were faultless. It is in all types of returns extremely important that the product is packaged in such a way that it cannot be damaged during transit. BA111OD has the Client right to replace defective goods with goods of the same model. If the item has been discontinued, the Client will receive an equivalent model or a full refund. In the case that a returned product has no errors or faults, BA111OD will return the product to the Client.

Liability
BA111OD’s responsibility for errors in connection to delivery is limited to existing conditions of sale. BA111OD bears no direct or indirect responsibility for example, but not limited to: incompatibility, delivery delays, downtime, data loss, additional work or other economic harm.
Force majeure
BA111OD shall be exempt from liability for damages and other flaws on the performance of the contract prevented, hindered or delayed by circumstances beyond our control. Circumstances included are: government intervention, new / amended legislation, lack of state, war, fire, flood, labor disturbance, prohibitions, restrictions, sabotage, poor transport or weather conditions, lack of delivery from suppliers or if the company is being exposed to criminal activity that affects the business.
Intellectual property rights
All intellectual property rights, such as trademarks and copyright, on the Website and in the material published on it, is owned by BA111OD. Any use of the Website or its content, including copying or storing such content in whole or part, other than for your own personal, non-commercial use, is prohibited without the permission of BA111OD.
Retention of title
All products remain in BA111OD’s property until full payment is made.
Fraud
All frauds are reported to the authorities and BA111OD reserves the right to cancel the purchase if any suspicion is raised.
Governing law and jurisdiction
The Terms & Conditions are governed by Swiss law, without regard to the principles of conflict of laws.
In the event of a dispute concerning the interpretation, execution or termination of the Terms & Conditions, we encourage you as a matter of priority to contact us in an attempt to resolve the dispute amicably.
BA111OD hereby notifies the Client that there are alternative dispute settlement options such as mediation. EU’s Clients might for example contact the platform of amicable solution to the dispute of the European Commission available at http://ec.europa.eu/consumers/odr/.
If the dispute cannot be settled amicably, you agree with us to bring the dispute before the Courts of the Canton of Neuchâtel (SWITZERLAND), subject to recourse to the Federal Court.
The terms of this article do not deprive Clients of their right to take legal action, or to defense in the event of legal action, in their country of residence or domicile, or of their right to consumer protection measures as set out in the legislation applicable in their country of residence.
Termination
BA111OD reserves the right to terminate your account and/or your use of the Website at its sole discretion. For example, if BA111OD suspects that you have breached these terms & conditions. Such termination can be made without prior notice.
Amendments
BA111OD may revise these Terms & conditions of use from time to time.
The Terms & Conditions in force at the time of purchase will apply to the contract between you and BA111OD. You should therefore occasionally visit this page to review the then current terms to which you are bound.
